Terms and Conditions

Welcome to MyPrescription (https://myprescription.homecloud.cloud), a SaaS platform owned, operated, and managed by Libernest Technologies Pvt. Ltd. ("Company", "we", "us", or "our"). By registering for, accessing, or using our services, clinics, doctors, and medical practitioners ("Clients", "you") agree to be bound by these Terms and Conditions.

1. Acceptance of Terms & Roles under DPDP Act

By using MyPrescription, you acknowledge that you have read, understood, and agreed to these Terms. Under the Digital Personal Data Protection (DPDP) Act, 2023, clinics and doctors act as Data Fiduciaries, while Libernest Technologies Pvt. Ltd. acts solely as a Data Processor on your behalf.

2. Patient Consent Obligations

You, as the clinic owner or doctor, warrant and covenant that you shall secure explicit, informed, and compliant consent from all patients before collecting, entering, uploading, or storing any personal or medical data on MyPrescription. Libernest Technologies Pvt. Ltd. bears no responsibility or liability for securing patient-level consent.

3. Third-Party Services, AI Models, and Clinic Consent

Access of clinic data and patient records to third-party services will be performed strictly with the prior consent or instruction of the clinic. For processing data in relation to the services provided, third-party services (such as artificial intelligence models and APIs) may be involved strictly for processing data to deliver core functional features. Third-party AI services are bound by their data protection standards.

4. AI Data Extraction, Mandatory Verification & Clinical Disclaimer

Artificial intelligence (AI) and automated data extraction tools are assistive utilities designed to facilitate clinical and prescription workflows. However, AI-generated data is inherently probabilistic and can be error prone; therefore, AI-generated data should not be solely relied upon for clinical, diagnostic, treatment, prescription, or administrative decisions.

Mandatory Verification: Doctors, healthcare practitioners, and their clinical staff are required to review and verify all AI-generated and AI-extracted data. The original documents (such as prescription images and scanned files) that are used for AI extraction remain available within the platform for cross reference and should be used by doctors and staff to validate all AI-generated data prior to acting upon or finalizing records.

5. Data Deletion and Bulk Export

Data deletion or bulk data downloads can be requested by emailing prescriptions@homecloud.cloud. Deletion requests must include the patient phone number or clinic name and will be actioned within 5 working days. Bulk downloads are subject to administrative verification.

6. Limitation of Liability

To the maximum extent permitted by applicable law, the aggregate liability of Libernest Technologies Pvt. Ltd., its directors, employees, and agents for any claims, damages, losses, or causes of action arising out of or related to the service shall be strictly limited to, and shall not exceed, the total subscription charges paid by the clinic to us for the immediately preceding one (1) month. We disclaim any liability for clinical, medical, or diagnostic decisions made on the basis of AI-extracted data without proper verification.

7. Indemnification

You agree to defend, indemnify, and hold harmless Libernest Technologies Pvt. Ltd., its directors, officers, employees, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) failure to secure patient consent; (c) misuse of patient data; or (d) any errors or incorrect data extracted or generated using AI, including any failure by doctors or clinic staff to verify AI-generated data against the original documents.

8. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes, controversies, or claims arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

9. On-Premise Clinic Deployment Option

If clinics desire a complete on-premise solution with all data staying in their physical control on a hardware appliance inside their clinic facility, we provide this architecture powered by Homecloud.
